RIGHTS AND REGULATION
Irving Azoff’s Music Artists Coalition has joined a court filing in the New York Times copyright case against OpenAI and Microsoft. The group joined the Human Consent Foundation, co-founded by Cate Blanchett, and CAA.
On October 30, the group asked the court for permission to submit a brief on whether rights can be identified, cleared and licensed at scale for AI-related uses. The case combines the Times lawsuit with other actions against OpenAI and Microsoft, including those brought by book authors, and also concerns whether training AI models on copyrighted works without a license is fair use.
On the same day, RIAA, NMPA, ASCAP, BMI and five other music organizations filed a proposed brief backing the plaintiffs, asking Judge Sidney Stein to rule that training on the plaintiffs’ works is not fair use. The cited co-signers include A2IM, Songwriters of North America, Black Music Action Coalition, Recording Academy and Artist Rights Alliance.
According to Music Business Worldwide, a ruling in favor of the technology companies could be cited in cases involving AI companies such as Suno, Udio and Anthropic. The music organizations’ brief also points to AI licensing deals and cites Deezer’s estimate that AI-generated tracks represent more than 50% of new music uploaded to the platform.
